Terms of business

The short version: we agree the scope and the price before starting. Half up front, half on launch. You own the site and the domain. Twelve months minimum on the monthly, then rolling. Nothing gets invoiced without being quoted first.

1. These terms

These are the standard terms on which IWCreator provides web design and related services. A specific project proposal takes precedence where the two differ.

2. What we provide

We design and build websites, and provide an ongoing service covering hosting, domain management, backups, monitoring and an enquiry inbox. Our packages and prices are published on the website.

We do not provide brand identity or logo design, original photography or illustration, web applications with customer logins or dashboards, or complex ecommerce. Where you need these we'll say so before quoting and can usually recommend someone.

3. Quotes and scope

Every project begins with Discovery. From that we produce a written specification setting out the pages, functionality and price. That specification is the scope.

Work outside it is quoted separately before any of it starts. We will not invoice you for something you haven't agreed to in writing.

Quotes are valid for 30 days.

4. Payment

  • 50% on acceptance, before work begins.
  • 50% on launch.
  • Invoices are payable within 14 days.
  • Late payment may attract interest and reasonable costs under the Late Payment of Commercial Debts (Interest) Act 1998.

We don't start without the deposit. It isn't a matter of trust — it's what protects the delivery slot we've held for you.

5. The monthly service

The monthly fee covers hosting, your domain registration, SSL, daily backups, uptime monitoring, enquiry delivery and storage, included content updates and email support. It begins on launch.

Minimum term is twelve months, after which it continues month to month until either side gives 30 days' notice.

It does not cover redesigns, new pages, or new functionality. Those are quoted as additional work.

If the monthly fee goes unpaid, we'll contact you. If it remains unpaid after a reasonable period we may suspend the site until it's settled. We'll always warn you first.

6. What we need from you

Projects stall on content far more often than on build. So:

  • Content, images and access details are due within 14 days of Discovery.
  • If they're outstanding beyond that, the project pauses and re-books into the next available slot.
  • You confirm you have the right to use any content you give us.

7. Revisions

Studio includes one revision round. Signature includes two. A round means one consolidated set of changes, not an open-ended series of individual requests.

Additional rounds are charged at the published rate, agreed before they start.

8. Your domain

Where we register a domain for you, it is registered in your name, not ours. You are the legal owner.

You may transfer it to another registrar at any time, for any reason, at no charge. We'll complete the transfer within 5 working days of your request.

9. Ownership

  • On final payment, you own the website — the design, the content and the code produced for you.
  • We retain ownership of our underlying tools, component libraries and methods, which are not exclusive to your project.
  • We may show the work in our portfolio unless you ask us not to.

10. Hosting and uptime

Sites are hosted on Cloudflare's network. We monitor uptime and act on outages, but we don't guarantee uninterrupted availability and we're not liable for failures of third-party infrastructure outside our control.

11. Ending the agreement

During a project: if you cancel after work has begun, the deposit is non-refundable and any work completed beyond it is chargeable. We'll be reasonable about this.

After launch: give 30 days' notice once the minimum term has passed. We'll transfer the domain and provide an export of the site and your enquiry data.

We may end the agreement for non-payment, or where behaviour toward us is abusive.

12. Liability

Nothing here limits liability for death or personal injury caused by negligence, or for fraud.

Otherwise, our total liability in connection with a project is limited to the fees you have paid for it. We are not liable for indirect or consequential loss, including lost profits, lost business or lost data.

We carry professional indemnity insurance.

13. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
